WEB SITE TERMS AND CONDITIONS Please read these Terms carefully before using this Website. By using this site, you expressly agree to all Terms and Policies set out below. We take great pride in our products. We have provided images and descriptions of our products which are made from wood, wood coatings and treatments, fabrics and at times manufacturing techniques in numerous places on this Web Site. Wood species, product composition, treatments and manufacturing techniques can and do vary by product and may change over time and without notice. As a result, final products may vary in color, finish, size, fabric or other features. Every effort has been made to ensure the accuracy of information including, but not limited to, prices, descriptions, availability and dimensions. However, we cannot be responsible for typographical errors. We reserve the right to correct any errors or omissions. Please review these policies carefully as they are the terms of sale that govern your purchases at Home Display Cases. They set out your rights and obligations with respect to your purchases, including important limitations and exclusions, such as those in Home Display Cases' product warranties. Your placement of an order either through this site or by telephone at the number listed above constitutes your agreement that these policies apply to the order, so be certain you understand them before you place your order. Taxes In states where we have no physical presence, we are not required to collect and remit sales tax for site purchases. The State of New Hampshire where we are located does not have a general sales tax. However, many states require that their residents file a sales or use tax return for items purchased on web sites. You should consult your state and local tax laws to determine compliance with tax laws and regulations in your area. The customer is responsible for all taxes. Shipping All items purchased from HDC are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you the purchaser upon tender of the item to the carrier. It is most important that you inspect the package upon delivery. It is your responsibility to check that all items are correct and all pieces accounted for before you sign. If the product is damaged in shipping, you may choose to refuse the delivery. If this happens please contact customer service to let us know of your delivery refusal. If only part of an item is damaged, you may elect to accept the order, note the damages, and contact us. We may be able to replace damaged pieces. If you notice the damage after you have accepted delivery you must contact us within 24 hours, as most carriers require claims to be filed within 48 hours. Returns If you wish to return the product you purchased for any reason you can return it within 30 days of your order for a full refund, excluding shipping and handling charges, unless we determine that the product received was our error. Our products are offered with free shipping, so please be aware that if you return a product our actual outbound shipping costs will be deducted from your return refund. All returns must be received by us within 45 days of the order and in re-salable condition and in the original packing, unless instructed otherwise. The product will be inspected within 3 days of our receipt and refunds are processed within 10 days of receipt. Prior to any purchase you must check to ensure the intended contents for display will fit inside the case. Each product page contains specifications that state the interior and/or viewable dimensions. It is your responsibility to ensure your items will fit properly. If you have any questions about dimensions please contact us. Limited Warranty Home Display Cases' warranty obligations for this product are limited to the terms set forth herein. Home Display Cases, as defined below, warrants its manufactured products against defects in materials and workmanship under normal use for a period of TWO (2) YEARS from the date of purchase by the original end-user purchaser (“Warranty Period”). If a defect arises and a legitimate claim is received within the Warranty Period, at its option and to the extent permitted by law, Home Display Cases will either (1) repair the defect at no charge, (2) exchange the product with a product that is at least functionally equivalent to the original product, or (3) refund the purchase price of the product, less any allowances for shipping and handling in accordance with our Return policy noted above. Home Display Cases may request that you replace defective parts with user-installable parts that HDC provides in fulfillment of its warranty obligation. A replacement product or part, including a user-installable part that has been installed in accordance with any instructions provided, assumes the remaining warranty of the original product. Parts provided by Home Display Cases in fulfillment of its warranty obligation must only be used in products for which warranty service is claimed. When a refund is given, the product for which the refund is provided must be returned to Home Display Cases and becomes Home Display Cases’ property. To obtain warranty service you must first contact customer service at 1-888-647-7670 or email at service@homedisplaycases.com This warranty does not apply to: (a) any product that was not securely installed, particularly when hanging or otherwise attaching the product to the wall; (b) to cosmetic damage, including but not limited to scratches, dents and blemishes that are reasonable in nature and within the nature of the product by Home Display Cases' standards; (c) to damage caused by handling the product improperly; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external causes; (e) to damage caused by operating the product outside the intended uses; (f) to damage caused by alteration performed by anyone other than Home Display Cases; (g) to defects caused by normal wear and tear or otherwise due to the normal aging of the product; (h) if any damage caused by placement of interior hardware or accessories, or (i) any condition resulting from improper maintenance or from commercial use. EXCLUSIONS AND LIMITATIONS TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. AS PERMITTED BY APPLICABLE LAW, HOME DISPLAY CASES SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE EXTENT PERMITTED BY LAW, HOME DISPLAY CASES IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS ; LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, PERSONAL PROPERTY. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. Legal HDC may update or modify these Terms and Conditions at any time and without prior notice. For this reason, you should review these Terms and Conditions each time you purchase products from us. Any action relating to the use of homedisplaycases.com must be brought in the state or federal courts located in the State of New Hampshire, Carroll County.
